How to Avoid Paying a non-existent Debt

A debt collection scam implies being contacted by someone posing to be a debt collector or a law enforcement agent or claiming to work under a business, court, or other official bodies, in a bid to recover funds for a debt, which in reality does not exist.

The scammer may request payment by bank transfer and resort to other violent methods such as threatening to visit the consumer’s home or workplace in a bid to recover the alleged debt. In other cases, the target may be threatened with arrest, bodily harm, or jail time. This is a common form of debt collection fraud.

Be sure to verify the number of the person calling you and claiming to be a representative of a debt collection agency, verify the legitimacy of the collection agency they claim to represent as well. Similarly, if you do not recall incurring the debt that they claim you owe, be sure to check your credit report to determine whether it is listed there. If everything checks out, ask the debt collection agency for a written validation of the debt which they claim you owe within five days from the first day they contacted you.

How to Defend yourself against Debt Collection Scams

  • Investigate: If the caller claims that you are being sued, they must be able to provide a warrant and case number along with the contact details of the court they are calling form. This can be used as a reference.
  • If the caller claims to be a court or law enforcement official, they must be able to identify themselves as with their identity card showing their number and photograph.
  •  Be sure to verify with your employer before agreeing to pay a debt on behalf of the business you work for. Fraudsters may tell you that you will be reimbursed by your employer when in reality, the debt does not exist.
  • Fraudsters can fake online profiles in a bid to get you to believe them. Do not believe that the outfit they claim to represent is genuine simply because they have an online presence. Be sure to check them out on other recognized platforms like the Better Business Bureau.
  • If your original debt collector has not informed you about your debt being transferred to a third-party, verify the collection agency’s claim by placing a call to your original lender.
  • Don’t be pressured to make a drastic decision based on a phone call.
