End harassment from Weltman, Weinberg & Reis Co., L.P.A.
If you are currently receiving calls from a debt collector who you suspect to be less than legitimate, you may want to read this post till the end. It is doubly important to be extremely cautious when dealing with a debt collector who you suspect to be less than reputable because a lot of people have been scammed in various ways. Here’s how debt collection scams work:
A scammer calls, posing to be a staff of a debt collection agency and claims to be receiving overdue payments. When you tell them that you do not remember incurring the debt, they make threats to arrest you, repossess your property, or sue you. Often, many consumers respond to this emotional pressure by succumbing to the demands of the fraudulent debt collector without making proper inquiries first. Do not do that. It is pertinent to note debt collectors do not have legal powers to arrest or jail you and most times the supposed overdue loan is non-existent. It is advisable not to yield, or else, the scammer would have won.
Another version in which scam is employed is when you get an unsolicited call from a debt collection agency and the caller claims that you have an outstanding debt that is about to go to court. The scammer may sound polite and appear to have your interests at heart. They further suggest you make a reasonable payment, even in installments to fix the situation. Beware! This is one old trick in the book of unethical debt collection tactics that many debt collectors employ to restart the clock on a loan for which the statute of limitations has expired, or which has been discharged in bankruptcy. The moment you make a payment on the loan, it comes back to life and gives the debt collection agency every right to pursue you for it.
Furthermore, harassment of any kind is prohibited during the debt collection process. If you suspect that you may be receiving calls from a fake collection agency, that your debt collection agency is trying to resurrect a zombie loan, or if you have been harassed and intimidated by a debt collection representative, do not hesitate to call us now on 844-791-1990.
Am I being scammed by a Fake Debt Collector?
If you suspect that you may be getting scammed by a fraudulent debt collector, request that they provide a written validation of the debt, this notice should include the amount of the debt, the original creditor’s name, and a statement of your right to dispute the debt. Do not proceed if the caller fails to provide this information.
Request for all the personal details of the caller (their name, company name, street address, and telephone number) and verify the legitimacy of the establishment. Avoid providing personal details like your bank account number, credit card details, or other sensitive information over the phone, especially to an anonymous caller. Such careless decisions can have drastic consequences.
Additionally, it is advisable to check through your credit report. Check with one of the three national credit reporting companies (Equifax, TransUnion, and Experian) to ensure that the debt is listed on your credit report. This helps you determine if the debt collector is trying to collect a legitimate debt or a non-existent one. If the scammer has your personal information, place a fraud alert on your credit report with the national credit reporting agencies.
