Harassment calls from National Debt Holdings?
Are you tired of facing debt collection harassment from National Debt Holdings? Do you now dread that moment when you walk to your mailbox in the morning only to be greeted by several envelopes containing bills you cannot pay?
Being in debt is a stressful situation, and it only gets worse when the several calls, texts, and letters you get from the debt collection agency responsible for collecting your debt become more and more excessive. We’ve heard several people complain about it, and we are sure it makes you tired too. However, there is good news.
The good news is that the law protects your rights in the context of debt collection through laws like the FDCPA and the TCPA. Under the TCPA, if a debt collector like National Debt Holdings violates those rights, then you may be able to sue them and get compensation ranging from $500 to $1500 for each violation claim.
What is the Fair Debt Collection Practices Act (FDCPA)?
The Fair Debt Collection Practices Act is a federal law that was enacted in 1978, to monitor the conduct of debt collectors throughout the debt collection process for the purpose of ensuring that they act fairly in their dealings with customers whose accounts are in default.
The FDCPA provides a list of what a debt collector is and is not allowed to do in the context of debt collection, and provides an avenue for consumers to take legal action against a debt collector who acts contrary to the law. Read more about it here.
What is the Telephone Consumer Protection Act (TCPA)?
The Telephone Consumer Protection Act (TCPA) clearly outlines what is acceptable and unacceptable conduct for business conducted over the phone. The act specifies that it is illegal to contact anybody without their consent and if you, or someone you know, are facing harassment as a result of unwanted phone calls, you can seek the help of a TCPA lawyer or a professional who understands TCPA guidelines.
Debt collectors are exempt from this rule, as the law does not require them to get your permission before calling you regarding a debt you owe, they are however required to respect your request to not be contacted further (if you write to them expressing such desire), and are also prohibited from making Robocalls to your residence or personal phone to advertise debt reduction plans.
