What qualifies as Debt under the FDCPA?

It is expedient to know that the FDCPA spells out “debt” and “consumers” in a way that covers only personal, family, or household undertakings. This means that if you owe a business debt or a business owes a debt or a person is contacted by a debt collection agency over a debt that was used for business purposes, it is not covered by the FDCPA.

What you should know about the TCPA

In 1991, the Government passed a bill called the Telephone consumer protection act (TCPA) in response to the rising complaints by consumers about the increasing amount of unwanted telephone marketing calls made to them, and the frequent use of automated and prerecorded messages. Hence if you are plagued by ceaseless phone calls from National Recoveries, this law is here to protect you.

The TCPA Laws state that when contacted by a debt collection agency, the telephone solicitation representatives must provide:

• A means of identification.
• The name of the individual or company they are contacting you for
• A telephone number or address at which that individual or company can be reached
The law also does not permit telephone representatives from making solicitation calls to your home before 8 am or after 9 pm. They are also required to oblige your request not to be contacted again.

Calls for which a charge is made to you. Also, the act prohibits sending unsolicited advertisements by fax to anyone without their prior consent. Violation of the TCPA laws include damages from $500 to $1500 per call.

• Threaten to sue you when they do not plan to.
• Make efforts to get you to pay more than you actually owe.
• Be deceitful about who they are or pretend to be attorneys or the government in order to scare you.
• Try to treat you like a criminal or tell you that you have broken the law and will be arrested.
• Deceitfully present false papers to you saying it is from the court.
• Tell you that they can take your benefits money (such as Social Security disability, pension, retirement, child support, alimony, or other protected funds).
• Call you at work after being informed that they are not allowed to.
• Share your debt information in other ways such as:
•Send you a postcard with information about your debt.
• Use social media platforms to mention your debt.
• Put up information about your debts in newspapers or magazines.
